TERMS AND CONDITIONS (T&C)

1.1 This online platform offers users the opportunity to offer movable and immovable goods as well as services for sale, or to contact the buyer/seller in order to conclude a purchase agreement. 1.2 The platform is available to both private individuals and legal entities. The seller may offer one or more movable or immovable goods or services through the platform. Tenants may log in to obtain information about desired landlords.

2.1 The contract between the platform operator and the user for the use of the platform comes into effect upon the user’s registration. 2.2 All users must provide their correct name or company name and give truthful information. Username and password are assigned by the system. The following details are required to log in: name or company name, full address, telephone number, e-mail address, date of birth (for natural persons) and preferred payment method for the usage fee (commission). 2.3 The platform operator is authorized, if necessary, to obtain information about users from third parties, insofar as it is related to this agreement. 2.4 The contract between the user and the platform operator is concluded once the user receives confirmation of registration. 2.5 For minors or persons under guardianship, written consent from a parent or legal guardian is required. 2.6 The platform operator reserves the right to refuse registration without providing reasons.

3.1 Sellers may offer movable and immovable goods as well as services for sale. Offers must be placed in the appropriate category. The sale of live animals, weapons, medicines, or drugs is strictly prohibited and will be reported to the authorities. 3.2 The seller is responsible for ensuring that the sale does not infringe any third-party rights, in particular ownership and intellectual property rights, and must obtain any required permissions. 3.3 It is forbidden to offer goods for sale if such offers are illegal or immoral. In particular, articles that are pornographic, racist, harmful to health, or connected with unconstitutional organizations are prohibited. 3.4 The offer must include a description of the article, the selling price, delivery terms, and contact details. VAT-liable sellers must declare that VAT will be added to the price. Uploaded photos must not violate third-party copyrights or personal rights. If the article is no longer available, it must be removed. 3.5 Offers must not contain advertising for other products.

4.1 To conclude a purchase contract, the buyer contacts the seller of the desired item directly. 4.2 The platform operator does not conclude sales or rental contracts and does not offer intermediary services between buyer and seller. 4.3 The platform operator assumes no warranty or representation concerning the fulfillment of contracts concluded through this platform, such as responsibility for items, payment, or delivery. 4.4 Communication between buyer and seller takes place directly.

5.1 The user is responsible, at their own expense, for ensuring access to the Internet and all necessary systems. 5.2 The username and password may only be used by the registered customer to whom they belong. These must be kept secret and chosen securely. 5.3 In case of loss or suspected misuse, the user must immediately inform customer service and, if possible, change the password. 5.4 Users may not misuse the platform or violate laws or the rights of third parties. 5.5 Users may not send advertising or spam to other users of the platform. 5.6 In the event of unauthorized or abusive use, the platform operator may temporarily suspend access without notice until security is restored. 5.7 In the event of violations or illegal offers, the platform operator may immediately block access and terminate the contract without refunding any fees. The user is liable for damages caused by such violations.

6.1 Use of the platform is free of charge for sellers and buyers. 6.2 Additional services can be subscribed to. 6.3 Sellers can pay their fees (subscriptions) via e-banking, credit card, direct debit, PayPal, advance payment, or invoice.

7.1 The platform operator guarantees careful execution of its services and commits to using up-to-date technical standards. 7.2 Liability is limited to damages resulting from willful misconduct or gross negligence. 7.3 Users acknowledge that, despite diligent maintenance, technical errors may occur. The operator is not liable for interruptions or data loss except in cases of gross negligence. 7.4 Maintenance work is carried out, where possible, during off-peak hours. 7.5 The operator is not liable for defects or failures caused by third parties or force majeure. 7.6 The operator is also not liable for viruses, malware, or other external interference beyond its control. 7.7 Users are informed about risks (e.g., spam, phishing) on the website. 7.8 Technical issues must be reported to customer support as soon as possible. 7.9 The operator guarantees compliance with data protection laws. 7.10 Data required for contract fulfillment may be stored and statistically evaluated but will not be disclosed to unauthorized third parties.

8.1 The contract ends upon expiration of the subscription or service. 8.2 If the platform operator discontinues its service, it will notify customers as early as possible.

9.1 Changes or additions to these T&C are only valid if made in writing. 9.2 The operator reserves the right to change fees (commission rates) and the T&C. Changes will be announced on the website, and users may print them. The user has the right to terminate the contract within 14 days; otherwise, continued use constitutes acceptance of the new terms.

10.1 This agreement is governed by Swiss law. If the user resides abroad, Swiss legal provisions shall nevertheless apply.
